Note about Color Accuracy of Physical Goods

Darker colors may be adjusted for printing as colors in the darker range print much darker than they appear on electronic devices due to the layering of physical ink. This tends to effect black, brown and blue shades the most. I have tinkered with this process and learned a lot about how certain colors print on acrylic - however, the same manufacturer may use different machines and produce slightly different results.In the event colors are VERY off, I will attempt to get them redone at no additional cost to you or refund you for the portion related to physical production. Also note that there may be color discrepancies between different device screens. I check all designs on two monitors, an iPad tablet, and phone screen to ensure it looks similar across different devices.My color palettes tend to be more saturated and warm toned.

Terms of Service (Long Version)

This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:1. ENGAGEMENT
a. Client provides clear and complete requirements and expectations upfront, including reference materials or assets before Work begins.
b. Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design and reference material for the use of the Work.
c. Client warrants that the character design and reference material provided to the Artist are legally obtained and authorized for use by the Client.
d. Client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.
e. Artist strives to perform to the best of their ability in good faith and warrants Work is 100% original according to Artist’s best knowledge.
f. Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.
g. Artist warrants that they will not copy or heavily reference unauthorized materials.
h. Artist reserves the right to refuse projects or requests based on content, subject, or other reasons.
i. Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord or Twitter, VGen platform, Google document, or email. The details set forth by the Artist shall be agreed upon by the Client before work begins.2. CONTENT RESTRICTIONS
a. Artist will not create content that is explicit, offensive, or inappropriate.
b. Other restrictions are on a case-by-case basis.3. TIMELINE AND PROCESS
a. Work completion requires 4 weeks minimum for digital art, and may take up to 3 months depending on each project. This includes production and shipping time.
b. Timeline depends on commission type, complexity, and workload.
c. Client should plan accordingly.
d. Artist provides progress updates and seeks Client feedback voluntarily.
e. Final deliverables are provided by the Artist using the VGen platform, Google Drive or similar file transfer tools.
f. If there are any delays and adjustments to timeline, the Artist will inform the Client.
g. Clients must first agree to delays and amendments to timeline exceeding 3 months through standard communication channels.
h. Clients have the right to request refunds 1 month after deadlines if Work has not been delivered and there was no agreed upon amendment to the timeline.4. REVISIONS
a. One major revision allowed per item shown to the Client during the process.
b. After line art, only minor revisions are allowed.
c. Additional charges for excessive revisions may be required.
d. Revisions may affect progress and timeline.5. COMMUNICATION
a. Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
b. Communication channels may include email, Discord messages, or Twitter private messages according to Artist discretion.
c. Artist response time may vary, up to one week in order to provide better or more concrete updates.6. RIGHTS & USAGE
a. Artist Rights
i. The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.b. Client Rights
i. Clients receive exclusive, non-transferable usage rights to the Work for personal use. Refer to Section 6.b. for commercial rights.
ii. Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.
iii. Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.
iv. Client must not edit or modify Work in any way without prior permission from the Artist.c. Commercial Rights
i. Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth) or as agreed upon.
ii. Commercial rights means usage of Work on streams or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.
iii. Usage of Work for AI (artificial intelligence) tools; platforms or programs, ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
iv. Additional charges will be required for commercial usage if not included, typically 2x of the original cost.7. PAYMENTS & FEES
a. Client pays 100% upfront before project begins.
b. Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist.
c. Invoices must be paid within 72 hours of the deadline stated on the invoice, or the project may be cancelled.
d. Prices are in USD, and paid via PayPal, or methods as provided by the Artist.
e. Prices may vary or change depending on complexity, requirements and/or additional requests.
f. Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.
g. Client warrants they will not issue chargebacks and the refund policy mentioned below will be followed.8. CANCELLATION & REFUNDS
a. If Client requests cancellation before work begins, a 100% refund will be issued.
b. No refunds are possible after work begins unless initiated by the Artist.
c. If Artist cannot complete work or there are delays as detailed in Section 3 for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund only.9. CONFIDENTIALITY
a. The Artist and Client acknowledges that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information), or are incorporated into the deliverables, that will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.10. INDEMNIFICATION
a. Client indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Client, breach by the Client of the Agreement, or third-party claims.
b. If Client's rights are violated or the Work is not delivered as agreed, Artist will work to remedy the situation first.11. ACCEPTANCE
a. Client is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
b. Agreement date is upon first inquiry/communication or first transaction.

Below is a gallery of all paid commission work I have done as of October 2023.Clean Lineart Type - Clients provided character references, pose references (if so desired) and other visual references they wished to be incorporated. Some details left up to me but you can be more specific if desired. WIP stages shared with client.Experimental Sketch Type - Clients submitted character references plus vibes they liked and left the rest up to me! No WIPs shared with client - final image only. All experimental sketch types were delivered within 1-3 days of receiving payment.

The following gallery is a collection of paid Your Character Here work done to raise money for charity. Donors gave a minimum amount specified to receive a sketch on one of two bases offered. Ace’s YCH Charity Comm Fundraiser Transparency Report

I’ve said it many times, but thank you once again to everyone who boosted and donated! In the interest of financial transparency, I’ve put together this report to detail how funds were spent in accordance with the terms outlined in the YCH form – purchasing e-SIMs via Nomad to provide communication lines to people in Gaza.Some customary donation report fluff before that – I was inspired to do YCH comms because I had seen a group of comic artists offering comms in exchange for e-SIMs purchased. It’s easy to feel like we can do nothing – that nothing will ever change - but I could do this much at least. I’m not sure how many of you have heard the star fish story, but it’s basically about someone throwing washed up star fish back into the ocean. Someone else comments, “There are so many. You can’t possibly save them all. You can’t begin to make a difference.” The person throwing star fish back into the ocean replies, “Well, I made a difference for that one!” I think of it like that. Not just in regard to charity either - there are so many little actions you can take in your day to day that would make a world of difference to someone else and you’d be none the wiser! The Process

Donations were collected via a donation link I set up through my PayPal. All funds stayed in my PayPal balance and were directly used to purchase eSIMs – any personal purchases through PayPal during this time used my external account balances.A minimum donation of $40 was required to receive a YCH comm.Once YCH comms were delivered to donors I would purchase eSIMs in batches to send to [email protected]. I followed the directions outlined on their site here: https://www.gazaesims.com/esim-purchase-tutorial/Screenshot proof of QR codes being forwarded to [email protected] can be found at the end of this report. Note: The screenshots are just of my filtered email inbox – there are no visible QR codes in the images.I opted to handle the collection of funds, purchasing, and forwarding of eSIMs myself to 1) make it very easy for people to donate and 2) ensure purchases were made and forwarded correctly.

The Numbers

Donation numbers have been rounded to the nearest tenth dollar to keep math easy (e.g. 125 → 130).
All dollar amounts are in USD.We raised a total of $520 between 11 donors over the span of 1 week!!

Note 1: One donor purchased a $40 Global eSIM with the intention of donating to the YCH. This purchase was verified and the QR code was properly forwarded to the eSIM charity group. The number of forwarded emails in my inbox is 25 (twenty-five) as opposed to 26 (twenty-six) since the donor forwarded the Global eSIM themselves. The $40 will also not be reflected in the PayPal fees.Note 2: The total spent says $522, but it’s actually a bit less. Every purchase of eSIMs had reward points where 1 point = 1 cent.50 points for every 3GB = 50 x 11 = $5.50
100 points for every 5GB = 100 x 10 = $10.00
150 points for every 10GB = 150 x 4 = $6.00That’s $21.50 from reward points, or $22 when rounded up, hence the difference between the $522 spent and the $500 of net donations received.

Proof of Purchase & Forwarding

The gallery below is just screenshots of my inbox to show Nomad eSIM purchases were forwarded. QR codes were in in body of email and the PDFs attached is the receipt from Nomad. I can provide more proof (PayPal receipts and purchases attached to these emails) if anyone wants it, however it may take a moment to put together since I’d have to redact a lot of info.

In-Stock Item Differences from Preorder Item Advertisement

IF YOU ORDERED THE MINI STANDEE CHARM: I am having stock reprinted to look like the sample in the original listing photos. There will be a delay of 3-4 weeks until I have new stock in hand. You will NOT be receiving the misprinted ones. If you still want the standee, just let me know you're ok with the delay.Orders without the standee will be processed as normal once you have reviewed the changes below.ALL OTHER STOCK: Changes vary, but none were as egregious to me as the mini standee charm. However, I will let you decide if you are ok with the changes.Official communications on Etsy will be going out during the evening of December 5, 2023 Central Standard Time.Colors may still appear differently dependent upon lighting. Photos varied from natural light to warm room lighting. Videos, which I feel have the best color accuracy, were taken in natural indirect lighting.

Pillowcase

Color Differences: Just a touch more saturated. This is most evident in the coat. The border is more cool charcoal grey than the warmer gray of the sample.Other Differences: The zipper is now on the side instead of the bottom. The shape of the pillow is still the same. I didn't stuff the new sample as much as the old one, but they are the same size.Other Notes: Please ignore the "wide face" distortion in these photos - they look just like the standees in person but the camera warped these guys a bit.Artist Thoughts: This one didn't bother me much, but of course you're free to request a refund.

Mini Standee Keychain (REPRINTING, 3-4 Week Delay)

NOTE: Orders with the standee are going to be delayed. If your order is affected, please let me know if you are ok with this delay or would like to cancel your purchase. The misprinted standees will not be going out to anyone.Color Differences: Somehow this reprint ended up MUCH more saturated and lightened despite the same file being used... Key differences are the hair being lightened considerably to the point the gradient lit part on the top is lighter than the skin.Other Differences: Color differences only.Other Notes: I tried to capture the colors as accurately as possible with my phone camera + photoshop adjustments. I'm not kidding at how saturated the reprint turned out.Artist Thoughts: If the hair was a bit darker I wouldn't mind as much, but this one is the most frustrating difference. Originally I did not want to get this reprinted with the same manu if they wouldn't admit fault, but I heard back and they admitted the color shift was due to their new printing technique + new printer. The order is currently being remade and the manu noted for production to use the old printers to match my previous sample. I'm hoping they turn out like the sample this time around! If not, I will be sourcing from a new manufaturer but let us hope it does not come to that.Unfortunately it will be another 3-4 weeks until I get the reprinted batch in hand.

Pinched Keychains

Color Differences: Similar to the standee for Gaius - lighter hair and more orangey due to saturation. Allie's colors turned out closer to her original file, such as the brown of her pants being lighter. Her shirt and eyes are also a bit more saturated.Other Differences: Color differences only. The video has better color accuracy than the photos. Don't mind the scratches you see on the back side as I did not remove the protective plastic film from these before shooting.Other Notes: None. Any appearance of size differences is just due to camera angling.Artist Thoughts: This one doesn't bother me as much since Gaius's palette overall is still harmonious in my eyes without the odd issue of his hair being lighter than his skin like the standee. Allie looks better than before to me, as well. You can still ask for a refund on this item if you'd like!

Glowing Werlyt Charm

Color Differences: The only noticeable difference I was able to spot was the border and text being more obviously blue. Other than that, all the other colors are just like the sample photos from the shop sample.Other Differences: The new one was printed interestingly. If you look at the photos, you'll see that the new version is printed on the top layer with transparency, then a whole translucent section below. It gives the charm an almost 3D, dreamy look on the back. The front is the same - both designs have actual shadows cast from them thru the transparent center, where a glow acrylic slice is sandwiched between them. Previously, the glow slice was on the outer side with the design printed directly on top.Other Notes: None.Artist Thoughts: I actually like how this one looks a lot. The glow is still out of this world and looks so pretty! Of course, you are still free to ask for a refund on this item.

Future Restocking / Stock?

I cannot guarantee any of these items will be restocked in the future and if they are restocked, how they will look due to potential changes in manufacturer.Likelihood of restocking is as follows:Pillowcases – Not bad, but next time I will specify for the manufacturer to place the zipper at the flat bottom like they did with the prior sample batch and in general will provide where I’d like the zipper to be for any future pillowcase designs. Pillowcases cost a bit more to have made, so I would likely do preorders again and expect the same mild color variation.Acrylic Goods – For the ones that turned out alright on the new printers + process, I can restock those with the same manufacturer. I am sourcing a different manufacturer for new designs going forward to ensure color consistency. HOWEVER, there are some acrylic goods this manufacturer offers that I have yet to find new sources for. Just like before, all future goods made will have sample tests done before preorders are offered to the public.I'd like to note that the manufacturer's updated printing process and new printers were not supposed to go into effect until December 1st for orders placed thereafter, per their own announcement. By this point the preorder stock had been produced and in transit by late November. Thankfully they are covering 100% of the remake costs!I may opt to do extremely limited runs over preorders in the future just so stock quality is consistent.
